Buying a home is one of the most exciting milestones of your life. To prepare yourself for this moment, you need to know what to expect during the process. This step-by-step first time buyer’s guide created by your agent will help reduce the stress of buying a home and help you enjoy the journey as much as possible.

Step 1: Research

Do you already know where you want to buy? If you want a condo, townhome, or single-family home? Which features do you like and dislike? What’s available on the market now? If you answered no to any of these questions, now is the time to start researching. In addition to looking for homes that interest you, also take note of any changes in asking prices. This could give you valuable insight into housing trends in specific neighborhoods and help you when the time comes to make an offer.

Step 2: Decide on Your Budget

Notice I said to decide on your budget—not determine how much the mortgage company will give you. In many cases, a mortgage company will pre-approve you for more than you’re comfortable spending, which is why you need to determine the monthly payment you feel comfortable with before talking to a lender. This likely includes doing a full household budget and taking into consideration what changes other than a mortgage payment will occur once you move into your new home. If you’ve lived in an apartment or with roommates, you may overlook new expenses like garbage, water, or HOA fees that could easily blow your budget.

Step 3: Get Prequalified

ust because you think you can afford a certain payment every month doesn’t mean the mortgage company will agree. Just as they may approve you for too large of an amount, they may also approve you for a lesser amount or deny you a mortgage altogether. Lack of time at a job, insufficient credit, past bankruptcies, or other financial issues can cause major problems when trying to secure a mortgage. Before you get your heart set on a home, talk to a mortgage professional to find out what amount you can qualify for. Step 4: Choose a Real Estate Agent

Can you shop for, look at, and ultimately make an offer on a home without a real estate agent? Step 5: Find the Right Home

This should be the most enjoyable step of the entire process (other than moving in!). I will arrange showings of homes you’re interested in that are within your price range. Take notes about what you like and don’t like, and make sure to pay attention to details. Turn light switches on and off, open and close doors, and run the faucets in various rooms. Don’t limit your inspection to the home itself. Make sure to take time to explore the neighborhood and keep an eye on traffic at certain times of the day, the parking situation, and how close it is to necessities like schools and grocery stores.

Step 6: Make an Offer

Once you have selected the perfect home, work with your agent to craft a fair offer based on the value of comparable homes on the market. Depending on what the home is listed at and whether the current environment is a buyer’s or seller’s market, your offer may be below, at, or even above the asking price. Step 7: Have the Home Inspected

In most cases, your offer will be contingent on having the home inspected to ensure there is no major structural damage or large repairs needed. If there is, you can renegotiate your offer based on what needs to be fixed, or you can withdraw it.

Step 8: Select Your Loan

Now is the time to go back to the mortgage lender who pre-approved or pre-qualified you and choose your mortgage. You will be presented with various options based on your unique financial situation, including fixed-rate, variable-rate, 15-year, 30-year, or special programs such as VA loans or FHA loans. Work with your mortgage lender to select the option you feel the most comfortable with.

Step 9: Get a Home Appraisal

Your lender will have your new home appraised so they have their independent value of it. The appraisal is to ensure that all parties involved are paying a fair price for the house.

Step 10: Finish Paperwork

No one looks forward to all the paperwork involved in buying a home, but it’s a necessary part of the process. Fortunately, everything will be arranged by your lender and title company and, when you’re finished, you’ll know you are the legal owner of your new home.

You’ll get a written report that identifies potential problems and future maintenance issues. It’s up to you to decide whether the report means you want to walk away from a house or ask the sellers to make repairs. You can also have an “information only” inspection, which means you’re buying the house as is, but want to know its condition.

      The inspector will check:

      • Mechanical systems such as heat and air conditioning
      • Appliances – to make sure they’re working

      A home warranty policy, which typically lasts for one year and is renewable, provides coverage for some of your home’s systems and appliances. In return for the annual fee, the company will cover repair costs and arrange for contractors. You’ll pay a deductible fee and possibly service fees if you need to use the warranty.

    • Do I need a home warranty?

      If you’re buying an existing home, especially one with appliances that are more than four years old, a home warranty can give you peace of mind about paying for unexpected repairs and finding a reliable contractor. If you’re a first-time buyer, especially if you have limited savings, this can be particularly important. If you have plenty of emergency savings, you’re handy or know good contractors, you may not need a warranty. Your real estate agent can also be a good source of recommendations for contractors. If you’re buying a newly built home, structural defects are usually under warranty by the builder for 10 years and other items are typically covered for six months to two years, so you don’t usually need a home warranty.

    • What should I look for in a home warranty?

    Some Tips for Selling a North Texas Home During Probate.

    According to William Sheetz, A preeminent Probate Attorney with extensive experience in DfW area probate courts,  "Real estate is usually the most valuable component of a deceased person’s estate, and few understand that during the Probate Process in Texas Courts,  the executor may sell the house of the Decedent or a person that has passed." Of course, Mr Sheetz explained,  there is a strict process in place that must be adhered to. The executor is granted the legal authority to manage the estate’s assets. The executor must be formally appointed by the Probate Court to have authority over estate assets. If the executor is not local to the property or other assets, the executor may name a Resident Agent to handle certain administrative matters and to sign in the executor’s stead with approval.

    The probate process begins with petitioning the court to appoint a personal representative of the estate. If there is a will, the court will issue ‘Letters Testamentary’ to the personal representative. If the decedent died without a will (‘intestate’) then the court will issue ‘Letters of Administration’ to the personal representative. These documents show the personal representative’s authority to manage estate assets. The personal representative should immediately contact the insurer to inform it that the home is no longer owner-occupied to ensure the homeowner's insurance policy remains in force.

    Once the personal representative is appointed by the court and notice of the probate is published, a four-month notice to creditor period begins to run.

    The personal representative may sell the real property during this four-month period but certain mandatory steps are required:

    1. Work with an experienced probate attorney and realtor knowledgeable with selling real property during a probate.

    2. Have the real property appraised by a licensed real property appraiser to establish a "date of death" value. Your Realtor can assist in identifying an appraiser and getting this commissioned.

    3. Consider a market analysis to determine an asking price for the real property. Your Realtor can conduct a home value report immediately to determine a fair market value or perhaps more importantly provide a broker price opinion to satisfy the court that the Sale price is fair.

    4. Obtain court approval to sell the real property.

    5. Make sure that all the beneficiaries are informed and in agreement with the sale of the home.

    The personal representative is exempt from seller disclosures. However, if the personal representative is aware of any issues with the home these should be disclosed to prospective buyers. The personal representative should provide the title company with a copy of the Letters Testamentary or Letters of Administration and the tax identification number for the estate. The personal representative signs the sale documents, including the deed to the third party purchaser. Any encumbrances on the property, including property taxes and loans, will be satisfied at closing. Once the sale is finalized the net sale proceeds must be deposited into an estate account. The sale proceeds can be used to pay valid claims against the estate as they arise and the balance distributed to the beneficiaries after the four month notice period runs and the court approves a final accounting.

    Mr Sheetz also explained that in ceratin circumstances, there is another salient benefit of selling a home during probate because only the personal representative needs to sign the sale documents and the net sale proceeds become available to help pay valid claims against the estate. If the home is not sold during probate then the personal representative distributes the home to the beneficiaries via a personal representative’s deed at the end of the probate with prior court approval. If the beneficiaries then wish to sell the home all the beneficiaries must sign the sale documents, which can complicate and/or delay the sale process. This is why we recommend selling during probate if there are many beneficiaries. Getting everyone to agree can definitely complicate matters.
